Terms of Service

These Terms apply to all Instag.ai services, including but not limited to:

• AI Agent automation workflows
• CDP (Customer Data Platform) features
• APIs, short links, integration modules, analytics, reports, and related SaaS services

By accessing, registering for, or using the Services, you confirm that you have read, understood, and agreed to these Terms.

• You must be at least 18 years old, or have consent from a legal guardian where required by law.
• Registration information must be accurate, complete, and not misleading.
• You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account.

• Instag.ai may add, modify, suspend, or discontinue features when necessary and may announce material changes on the official website or through the platform.
• Beta or preview features are provided for evaluation and may not be stable or continuously available.
• Features that rely on third-party APIs, including Meta, Google, LINE, YouTube, or other platforms, may be affected by third-party policies, outages, permissions, or API changes.

• The Services are generally offered under subscription plans such as Starter, Pro, and Enterprise, with pricing subject to the official website, order form, or applicable written agreement.
• Add-ons, including tokens, video generation, short-link capacity, or additional usage, may be charged separately.
• Fees are non-refundable except where required by law or expressly stated in a written agreement.
• Instag.ai may adjust plan pricing when necessary and will provide advance notice where appropriate.

You may not use the Services to:

• violate applicable laws or infringe the rights of others
• send spam, fraudulent, deceptive, or abusive messages
• collect, process, or share personal data without proper authorization
• attempt to hack, reverse engineer, overload, disrupt, or interfere with the Services

Instag.ai may restrict, suspend, or terminate accounts that violate these Terms. You are responsible for backing up your own data. Instag.ai is not responsible for data loss caused by user deletion, misconfiguration, unauthorized access resulting from user-side credential exposure, or similar user-controlled events.

• The software, systems, designs, trademarks, and other materials related to the Services are owned by Instag.ai or its licensors.
• Content and data uploaded by customers, including customer lists, creative materials, campaign data, and marketing assets, remain owned by the customer or the relevant rights holder.
• Instag.ai uses customer content only as necessary to provide, secure, maintain, support, and operate the Services, and does not sell customer content.
• You grant Instag.ai a worldwide, non-exclusive, royalty-free license to process, display, transmit, and use customer content solely as necessary to provide the Services, including data processing, system display, support, security, and API calls.

• Instag.ai AI Agent features perform automated tasks based on user configuration, such as ad operations, content workflows, and message delivery.
• AI-generated content, recommendations, and automated actions must be reviewed by the customer, and the customer remains responsible for final use, publication, campaign decisions, and compliance.
• You are responsible for ensuring that your settings, campaigns, audiences, content, and advertising comply with applicable laws and third-party platform policies.
• AI Agent features may not be used for unlawful purposes, including political manipulation, disinformation, infringement of intellectual property rights, or unauthorized processing of personal data.

• Instag.ai collects, processes, and uses data in accordance with the Privacy Policy and applicable agreements.
• For customer-provided member, audience, or end-customer data, Instag.ai generally acts as a data processor or service provider on behalf of the customer, while the customer retains ownership and control of its data.
• Upon termination of the Services, Instag.ai will delete or return customer data in accordance with customer instructions, applicable agreements, technical feasibility, and legal retention requirements.

• Instag.ai is not liable for service interruption or damage caused by force majeure, third-party system failures, cyberattacks, platform policy changes, or other events beyond reasonable control.
• To the maximum extent permitted by applicable law, and except in cases of intentional misconduct or gross negligence, Instag.ai liability for damages arising from the Services is limited to the service fees paid by the user in the most recent one-month period, unless a separate written agreement states otherwise.

• If you violate these Terms, Instag.ai may suspend or terminate the Services immediately without refunding paid fees, except where required by law.
• You may stop using the Services at any time, but paid fees remain non-refundable unless otherwise required by law or agreed in writing.

• These Terms are governed by the laws of the Republic of China (Taiwan), without regard to conflict-of-law rules.
• Unless otherwise agreed in writing, the parties consent to the Taiwan Taipei District Court as the court of first instance for disputes arising from or related to these Terms.

• Instag.ai may update these Terms from time to time and publish the updated version on the official website.
• For material changes, Instag.ai may notify users by email, platform notice, website announcement, or other reasonable means.
• Continued use of the Services after the updated Terms become effective constitutes acceptance of the updated Terms.
